Possession of Marijuana, K2, and Wax
It’s legal in quite a few states now, but not in Texas…
If you pick up a Possession of Marijuana (POM) charge, you first need to recognize that Texas treats this as a serious matter. Possession of any usable amount of marijuana less than 2 OZ. is currently a Class B misdemeanor offense in Texas, and is punishable by up to six months in jail and a $2,000 fine. Additionally, a conviction for possession of marijuana will result in your driver’s license being suspended for six months.

SYNTHETIC MARIJUANA (SPICE, K2, POTPOURRI)
Synthetic marijuana is a phrase that refers to designer drugs made by spraying chemicals that mirror (with great distortion, and often catastrophic results) the effects of cannabis. K2, Spice, LOL, Potpourri, and other varieties of synthetic cannabinoids were previously sold in head-shops that operated in a grey-area of the law. However, as of 2016, synthetic marijuana (in all forms) is illegal and punishment ranges from six months in jail and a $2,000 fine, to life. A conviction will also result in a suspension of your driver’s license.
WAX, BUTANE HASH OIL, DAB
Possession of any amount of wax (butane hash oil, dab) is a felony. (See more on felony drug charges: http://www.georgeroland.com/possession-of-a-controlled-substance/) Wax is made by placing marijuana into a tube or pipe and then hitting the pipe with a rush of butane (“blasting.”) This process extracts the THC from the marijuana, and is highly potent. As with possession of marijuana and synthetic marijuana, a conviction for possessing wax will result in a suspension of your driver’s license. It will also result in a felony conviction.
DEFENSE TO POSSESSION
It is critical to note that having a medical marijuana card issued by a state other than Texas is not a defense to possession of marijuana. Nor is the fact that marijuana use for recreational and/or medicinal purposes is now legal in the overwhelming majority of states.
